Voici les derniers textes essentiels publiés dans le cadre de la crise de la COVID, pouvant avoir des impacts sur votre activité.

1- Allocation d’activité partielle : nouvelle adaptation du dispositif de modulation !

Cette adaptation concerne les entreprises relevant des secteurs les plus touchés ou relevant des secteurs dépendant de ces derniers.

En complément du dispositif actuel, une nouvelle ordonnance introduit la faculté de majoration de l’allocation pour les employeurs relevant des secteurs protégés qui continuent de subir une très forte baisse de chiffre d’affaires. Un décret doit fixer les conditions d’appréciation de la forte diminution du chiffre d’affaires dont devront justifier les entreprises relevant des secteurs protégés. Cette diminution sera appréciée mensuellement par comparaison entre le chiffre d’affaires de 2021 et celui de 2020 ou 2019 (au choix de l’employeur).

Par ailleurs, il est désormais précisé que, pour les secteurs dépendant des secteurs les plus affectés, la perte de chiffre d’affaires prise en considération est celle qui a été subie en 2020.

Ces nouvelles dispositions s’appliqueront aux demandes d’indemnisation pour les salariés placés en activité partielle à compter du 1er mars 2021 et jusqu’à une date fixée par décret, et au plus tard le 30 juin 2021.

2- Covid : nouvelle ordonnance relative aux mesures d’urgence en droit social

De nouvelles prolongations concernant l’activité partielle, la santé au travail et les demandeurs d’emploi sont prévues par une ordonnance du 10 février 2021. Concernant l’activité partielle la modulation des taux d’indemnisation et de l’aide de l’État pourra s’appliquer jusqu’au 31 décembre 2021 au plus tard, au lieu du 30 juin 2021. Concernant les services de santé au travail :

  • le report des visites médicales s’applique aux visites qui doivent être réalisées jusqu’au 2 août 2021 (au lieu du 17 avril 2021) ;
  • la période au cours de laquelle l’activité des services de santé au travail doit être centrée sur l’appui aux entreprises dans la lutte contre l’épidémie est prolongée jusqu’au 1er août (au lieu du 16 avril 2021).

Concernant les demandeurs d’emploi, la durée d’indemnisation des personnes arrivant à épuisement de leurs droits est prolongée jusqu’au dernier jour du mois civil au cours duquel intervient la fin de l’état d’urgence sanitaire. Cette mesure pourra toutefois être interrompue en fonction de la situation sanitaire.

3- Fonds de solidarité : Les dernières évolutions

Les derniers décrets publiés fixent les conditions d’éligibilité pour le mois de janvier et apportent des modifications pour les mois précédents.

Le gouvernement travaille également à étendre l’aide complémentaire sur les charges fixes aux plus petites structures qui ne feraient pas 1 million d’euros de chiffre d’affaires par mois mais qui auraient d’importantes charges fixes à l’image des salles de sport, des activités indoor et des centres de vacances.

1- FSE pour le mois de janvier :

Pour l’aide au titre du mois de janvier 2021, les critères d’éligibilité ont été fixés. Le décret du 8 février 2021 étend le dispositif initial et complémentaire prévu pour le mois de décembre 2020 sans apporter de nouveaux critères.

Par ailleurs, les secteurs des annexes 1 et 2 sont ajustés pour l’aide du mois de janvier. Les entreprises de la filière viticole sont transférées de l’annexe 2 à l’annexe 1. Il est ajouté à l’annexe 2 neuf nouveaux secteurs liés à la fermeture des remontées mécaniques.

Le formulaire relatif à l’aide de janvier sera mis en ligne sur le site impots.gouv.fr fin février. Les demandes pourront être déposées jusqu’au 31 mars 2021.

2- FSE pour décembre 2020 pour les commerces de station de ski :

Les commerces situés dans des stations de skis bénéficient dès le mois de décembre 2020 de critères d’éligibilité spécifiques. Ces entreprises, perdant au moins 70 % de leur chiffre d’affaires, ont notamment le droit à une indemnisation couvrant 20 % de leur chiffre d’affaires 2019 dans la limite de 200 000 € par mois.

3- FSE du mois de décembre 2020 pour les entreprises de l’annexe 2 :

Des modifications ont également été apportées pour les entreprises visées par l’annexe 2 du décret au titre de l’aide du mois de décembre. Ces entreprises, perdant au moins 70 % de leur chiffre d’affaires, ont le droit à une indemnisation couvrant 20 % de leur chiffre d’affaires 2019 dans la limite de 200 000 € par mois.

4- FSE du mois de novembre 2020 pour les entreprises de l’annexe 2 :

Enfin, de nouvelles activités listées en annexe 2 peuvent déposer une demande d’aide ou de versement complémentaire au titre du mois de novembre 2020. Cela concerne les entreprises des secteurs suivants :

  • édition et diffusion de programmes radios à audience locale, éditions de chaînes de télévision à audience locale ;
  • correspondants locaux de presse ;
  • fabrication de skis, fixations et bâtons pour skis, chaussures de ski ;
  • réparation de chaussures et d’articles en cuir.

Les demandes pourront être déposées jusqu’au 28 février au lieu du 31 janvier 2021.
