Télétravail et activité partielle : adaptations suite à la fermeture des écoles

Le Gouvernement et les organisations syndicales se sont entretenus sur les nouvelles mesures de restrictions sanitaires mises en place pour freiner la circulation du virus. Congés payés, télétravail, fermeture des crèches et écoles, Ormeo vous présente les mesures d’adaptation venant d’être publiées.

La ministre du Travail, de l’Emploi et de l’Insertion, Élisabeth Borne et le secrétaire d’État chargé des Retraites et de la Santé au travail, Laurent Pietraszewski, se sont entretenus avec les organisations syndicales et patronales sur les nouvelles mesures de restrictions sanitaires mises en place pour freiner la circulation du virus.

Le sujet de l’impact de la fermeture des écoles et des crèches sur la vie des salariés et des entreprises a été abordé, notamment l’articulation des vacances scolaires et de l’activité partielle, mais aussi la mise en place du télétravail.

Faciliter la prise de congés

À l’issue de cet échange, les employeurs sont invités à faciliter la prise de congés de leurs salariés qui ont des enfants sur les nouvelles dates de vacances scolaires (du 10 au 26 avril 2021) lorsqu’ils avaient déjà prévu leurs congés à des dates ultérieures. Il a été convenu avec les partenaires sociaux que cette solution devait être mise en œuvre dans le cadre du dialogue entre le salarié et l’employeur.

En droit commun, la période de prévenance est habituellement d’un mois pour poser ses congés. En bonne entente entre le salarié et l’employeur, il peut être décidé de modifier les dates de congé initialement prévues dans un délai plus court. Dans certains cas, la possibilité pour l’employeur d’imposer au salarié la prise de jours de congés ou de RTT, prévue par l’ordonnance du 16 décembre 2020, pourra également être utilisée.

Concrètement, cela veut dire que :

  • Pour un parent de la zone B (initialement en vacances du 24 avril au 10 mai), le salarié pourra demander d’avancer ses congés de 15 jours ;
  • Pour la zone C (initialement en vacances du 17 avril au 3 mai), le salarié pourra demander d’avancer sa semaine de congés si elle était prévue du 25 avril au 3 mai ;
  • En zone A (dates de congés maintenues du 10 au 26 avril), il partira en congé comme prévu.

Par ailleurs, pour faciliter les modes de garde, les déplacements entre régions seront autorisés pour amener ou aller chercher un enfant ou plusieurs enfants chez un proche.

Si le salarié ne peut pas décaler ses congés, qu’il ne dispose pas de mode de garde et qu’il est dans l’incapacité de télétravailler alors, il pourra être placé en activité partielle.

Suite à une réunion entre les partenaires sociaux et le ministère du travail, une note du pôle social du MEDEF relative à l’adaptation des mesures d’urgence a été communiquée.

La note précise que suite à la fermeture des établissements scolaires et des crèches, les salariés dans l’incapacité de télétravailler pourront demander à bénéficier de l’activité partielle pour garder leur enfant, s’ils sont parents d’un enfant de moins de 16 ans ou d’un enfant en situation de handicap, sans limite d’âge.

Le salarié devra remettre à son employeur une attestation sur l’honneur indiquant qu’il est le seul des deux parents demandant à bénéficier de l’activité partielle au motif de la garde d’enfant.

Les salariés bénéficieront alors d’une indemnisation à hauteur de 84% de leur rémunération nette ou de 100% pour les salariés au SMIC, avec 0 reste à charge pour les employeurs (100% de l’indemnité versée).

Un projet de décret en ce sens a été envoyé aux partenaires sociaux pour consultation, il serait rétroactif au 1er avril.

La Ministre du Travail, à la suite de la réunion multilatérale du 1er avril 2021 avec les partenaires sociaux, précise que ce dispositif s’appliquera pour :

  •  les salariés dont le poste n’est pas télétravaillable ;
  • les salariés dont l’activité est en principe télétravaillable, mais qui ne sont pas en mesure de travailler, parce qu’ils doivent garder leurs enfants de moins 16 ans ou handicapés. Dans ce cas, ils doivent informer leur employeur et demander à être placé en activité partielle.

Selon le ministère : « chaque salarié peut avoir une discussion avec son employeur ou manager en fonction de sa situation personnelle. »

Les situations doivent être traitées au cas par cas, lorsque le télétravail est incompatible avec la garde des enfants dont les crèches et écoles sont fermées.

La procédure

Concrètement sur ce dernier point :

1) le salarié doit informer son employeur de son incapacité à télétravailler pour garde d’enfant(s) de 16 ans ou handicapé(s) ;

2) le salarié doit remettre à son employeur une attestation sur l’honneur indiquant qu’il est le seul des deux parents demandant à bénéficier de l’activité partielle au motif de la garde d’enfant(s) ;

3) l’employeur doit adresser une demande individualisée d’activité partielle pour le salarié concerné sur la plateforme suivante : https://activitepartielle.emploi.gouv.fr/aparts/
